Service Agreement

Pochtoy.com LLC, a resident of the United States of America, referred to as the Contractor, and a legally capable adult individual, referred to as the Client, enter into this agreement:
1. General provisions
1.1. The Contractor provides intermediary services related to purchasing goods in US online stores and auctions according to this agreement.
1.2. The Contractor may amend this agreement. The Client must monitor changes at https://pochtoy-test.pochtoy.com/ru/agreement.
1.3. The Client accepts the agreement during registration.
1.4. Fees are charged according to current tariffs at https://pochtoy-test.pochtoy.com/ru/services.
1.5. The Client must read and accept the service rules at https://pochtoy-test.pochtoy.com/ru/faq.
2. Service procedure
2.1. When creating an order, the Client must account for item cost, US domestic shipping, and sales tax. If costs change or were not included, the Contractor may deduct the necessary amount from the Client's balance within the limits described in the service rules.
2.2. The Client is responsible for choosing correct sizes and must specify them exactly as used by the seller. Unless stated otherwise, sizes are treated as US sizes.
2.3. All purchased goods must comply with delivery service rules and customs laws of the Client's and Contractor's countries.
2.4. Purchases on eBay.com are allowed only from sellers with a rating of 10 or higher.
2.5. The Contractor pays for goods on behalf of the Client using funds from the Client's balance and buys only from sellers that deliver within the USA.
2.6. If an item is out of stock, the Contractor may mark it as unavailable. The Client may replace or remove it.
2.7. Free warehouse storage is 70 calendar days after arrival. Further storage follows tariffs at https://pochtoy-test.pochtoy.com/ru/services. Unpaid storage may result in disposal without additional documents.
2.8. If the seller does not ship the item, the Contractor will try to recover funds but cannot guarantee compensation.
2.9. The Contractor packs goods for shipment according to Client preferences when possible. If a parcel exceeds selected service limits, the Contractor may change the delivery service to the nearest available option unless the Client explicitly objects.
2.10. Agreement text, tariffs, terms, and processing times may be changed unilaterally.
2.11. The Contractor may refuse to purchase any item without explanation.
2.12. The Contractor may refuse service at its discretion.
3. Balance top-up
3.1. The Client may top up the balance by methods listed at https://pochtoy-test.pochtoy.com/ru/new-user-room/balance.
3.2. The Contractor may provide or refuse credit at its discretion.
3.3. If free US shipping becomes unavailable because part of an order is missing, the paid US shipping cost may be deducted from the Client's balance.
4. Virtual Address and Full Support
4.1. The Client must pay for Pochtoy.com goods and services only using credit or debit cards, PayPal, and bank transfers from accounts personally owned by the Client. Gift card payments are prohibited and may lead to account blocking and return of goods.
4.2. The Client must not include in orders or send to the Contractor items prohibited by US law or by the law of the parcel destination country.
4.3. The Contractor is responsible for Client goods only from the moment they are handed to the warehouse by the postal service.
4.4. The Contractor is responsible only for the actual accepted weight of goods.
4.5. The Contractor is not responsible for orders with incomplete or incorrect virtual address details.
4.6. Incoming parcels must be shipped from the warehouse within 90 days after arrival. Unpaid parcels after that term may be handled at the Contractor's discretion.
4.7. Under Virtual Address, payment and shipment of goods sold by private individuals is prohibited, except eBay purchases paid through PayPal.
4.8. Under Full Support, goods are not weighed during acceptance; only order matching is checked.
5. Parcels and delivery
5.1. Delivery tariffs can be estimated with the calculator at https://pochtoy-test.pochtoy.com/ru/prices. Shipment cost consists of delivery and mandatory insurance. Calculator results are informational.
5.2. Delivery is paid after goods arrive at the warehouse. Final delivery cost is calculated after assembly and weighing in the Parcels section of the Client's account.
5.4. The Client may change parcel contents, assembly preferences, insurance value, and declaration before confirmation unless otherwise stated.
5.5. Delivery is paid separately from the order after the assembled parcel is weighed.
5.6. Delivery payment may be deducted automatically if the Client agreed before confirming the parcel and has sufficient balance.
5.7. If automatic payment is declined, an invoice is issued after weighing and the Client must confirm payment or top up the balance.
5.8. If delivery is not paid, the parcel is stored for 7 days after confirmation.
5.9. The Client fills out the customs declaration and is fully responsible for it. Correcting a knowingly false declaration is a paid service.
5.10. Services are considered fully provided when the parcel is handed over to the postal service.
5.11. The Contractor is not responsible for postal delivery speed. Delivery times are estimates.
5.12. The Contractor does not deliver to Crimea.
5.13. The Contractor does not handle compensation claims with postal services.
5.14. The Contractor is not responsible if a parcel fails customs clearance or is questioned by authorities.
5.15. The Contractor is not responsible for re-export costs or return timelines.
6. Contractor obligations
6.1. The Contractor performs Client requests related to the services when those requests do not contradict this agreement, US law, postal rules, and customs regulations.
7. Client obligations
7.1. The Client must provide complete and accurate information. If reliability is questioned, the Contractor may suspend services and request identity documents, bank statements, order copies, or payment card photos.
7.2. The Client must pay service costs, goods costs, Contractor expenses, and possible balance debt in full and on time.
7.3. The Client must keep payment receipts and transaction information until the balance is credited.
7.4. The Client must not use goods ordered through the Contractor for commercial purposes.
7.5. The Client must not create more than one account.
7.6. The Client is responsible for complete and correct item characteristics, including color, size, and article number.
8. Return and exchange of goods
8.1. Under Full Support or Buyer Purchase services, return or exchange of goods of proper quality received at the warehouse is not performed.
8.2. Under Virtual Address, return from the Contractor's warehouse to the seller is possible only for an additional fee. The Contractor does not verify item match and is not responsible for seller or Client checkout mistakes.
8.3. If goods were delivered to the destination country and the Client wants to return them, the Client must ensure the seller return period remains valid, prepare all required documents and packaging, arrange courier delivery to the US warehouse at the Client's expense, and pay the return cost after warehouse arrival.
8.4. The Contractor does not guarantee successful return even if all requirements are met. The Client accepts all risks and service fees are not refunded if the return fails for reasons outside the Contractor's control.
9. Limitation of liability
9.1. The Contractor is not liable for Client expenses or direct or indirect damages caused by service errors, failures, interruptions, file deletion, function changes, defects, or data processing delays.
9.2. The Contractor is not liable for payment systems, postal services, transport companies, email service, internet providers, and similar third parties.
9.3. The Contractor is not liable for delivery times from the seller to the warehouse or from the warehouse to the Client.
9.4. The Contractor is not liable for item quality, completeness, or appearance and does not provide warranties for purchased goods.
9.5. The Contractor does not inspect goods for visible or hidden defects unless a paid service is ordered.
9.6. The Contractor is not liable for seller misconduct selected by the Client.
9.7. The Client agrees not to bring the Contractor into disputes with stores, sellers, postal services, payment systems, and similar parties.
9.8. Declaration accuracy and customs compliance are fully the Client's responsibility, even if the declaration is filled out by the Contractor on the Client's behalf.
9.9. The Contractor is not liable for customs fees and does not compensate them.
9.10. Any compensation for Contractor employee errors cannot exceed the Contractor's commission.
9.11. Insurance compensation is paid only for insured parcels and cannot exceed the insured value of goods.
9.12. Insurance payment requires proper parcel receipt procedure by the Client.
9.13. Parcels may be insured only against complete loss by the postal service unless specific insurance terms say otherwise.
10. Force majeure
10.1. The parties are released fully or partly from obligations in case of force majeure events that could not be foreseen or prevented by reasonable measures.
11. Dispute resolution
11.1. Disputes related to this agreement are resolved through negotiations.
11.2. Unresolved disputes are resolved according to the laws of the United States of America.
12. Bonuses, coupons, and affiliate program
12.1. Accrued bonuses and coupons, including monetary equivalents, cannot be withdrawn, transferred to other accounts, or combined.
12.2. Bonus, promo code, and affiliate program terms may be changed without notice.
